The Data Protection Act 2017 is designed to strengthen the controls and personal autonomy of individuals over their personal data, in line with current relevant international standards. The Privacy Policy adopted by HAR describes how HAR collects and uses Personal Data of individuals during the period in which we are engaging with them and after.

Personal data, or personal information, means any information about an individual from which that person can be identified. The personal information collected and processed by the Company (in paper and electronically) includes:

The Privacy Policy explains the purposes for which HAR processes personal data with a view to fulfil its duties and responsibilities, which includes:

  2. Our legal duty

In any event, HAR is committed to ensuring that the information it collects, and processes are appropriate for the purpose for which it was collected.

HAR reassures its clients that any disclosure or transfer of personal data to third parties and/or to different countries will only be done if it fits under any of the above purposes.

HAR may use your personal data to inform you about relevant products and offers. The personal data we have about you is made up of what you voluntarily gave to us and the data we collect under circumstances mentioned in section 5 above.

We can use your personal data to send you marketing correspondences if we have your consent. You may request us to stop sending you such correspondences by notifying the Company in writing at any time.

We may also ask you to confirm or update your personal data and/or your choices (e.g. your preferred channel of communication) in the future.

 If you are invited to events organised by HAR, photos and videos of you taken during the event may be later used for the purpose of communication in the press, social media and for other promotional activities.

 Your invitation or the advertisement of such events will contain a notice to the effect that during such events, you may be photographed/filmed for the purpose mentioned above. You can always contact our Data Protection Officer if you do not wish the company to use your images.

  1.  To whom will the data be disclosed?

Furthermore, HAR may share your personal data either with your consent or by operation of law with external third parties within or outside the territory of Mauritius only if doing so fulfils any of the duties and responsibilities as mentioned in section 4 above. They include amongst others:

  • service providers based in Mauritius acting as processors who provide IT and system administration services, payroll services, etc.
  • service providers based outside Mauritius acting as processors who provide IT and system administration services.
  • professional advisers based in Mauritius acting as lawyers, bankers and auditors amongst others.
  • the Mauritius Revenue Authority, regulators and other authorities based in Mauritius who require reporting of processing activities in certain circumstances.
  • our suppliers outside Mauritius to fulfil our contractual obligation we have entered into with you.

 We require all third parties to respect the security of your personal data and to treat it in accordance with the law. We do not allow our third-party service providers to use your personal data for their own purposes and only permit them to process your personal data for specified purposes and in accordance with our instructions.

 We limit access to your personal data to those employees, agents, contractors and other third parties who have a business need. They will only process your personal data on our instructions, and they are subject to a duty of confidentiality.

HAR will keep your personal data for:

  • the period required for the purpose for which it is initially collected, or
  • the period as may be necessary for HAR’s compliance with legal obligations.

You acknowledge, understand and agree that HAR will, for the purpose of providing its services to you during the usual course of its business operations, collect and where necessary required, process the personal data voluntarily communicated by you.

However, notwithstanding the withdrawal of your consent, your personal data may still be processed by the Company in the performance of its statutory duties.

We are committed to ensuring that your information is secure with us and with the third parties who act on our behalf. We have several security measures in place to prevent the loss, misuse or alteration of your information. All staff working for HAR have a legal duty to keep information about you confidential. The Company has strict information security policies and procedures in place to ensure that your information (whether held in paper or electronic format) is safe.

  • Request access to your personal data. This includes details of what information we hold about you and a copy of that information. The information will be provided free of charge and, unless there are grounds for extending the statutory deadline, the information will be provided to you within one month of receipt of your request.
  • Request rectification of the personal data that we hold about you. This enables you to have any incomplete or inaccurate data we hold about you corrected, though we may need to verify the accuracy of the new data you provide to us.


  • Request erasure of your personal data. You may request to delete or remove personal data where:
    • there is no good reason for us continuing to process it
    • you have successfully exercised your right to object to processing (see below),
    • you deem the processing of your personal data to be unlawful, or
    • we are required to erase your personal data to comply with local law.


Note, however, that we may not always be able to comply with such a request where it is necessary to keep your information for the purposes of establishing, making or defending legal claims.

  • Where you deem the processing of your personal data to be unlawful, but you do not want us to erase it.
  • Where you need us to hold the data even if we no longer require it as you need it to establish, exercise or defend legal claims.
  • You have objected to our use of your data, but we need to verify whether we have overriding legitimate grounds to use it


  • Withdraw consent at any time where we are relying on consent to process your personal data. The information will be provided free of charge. However, we may charge a reasonable fee if your request is clearly unfounded, repetitive or excessive. You will consequently bear the consequences of such erasure and we shall in no way be liable should we be unable to provide any services and/or comply with our contractual obligations to you following such erasure.


Please note we will generally also ask for confirmation of your identity and may need further information from you in order to locate the information, in which case the time period starts from the date we have that detail.  Please note that in some cases we may not be able to comply fully with your request, such as where your request also involves information about someone else and where confidentiality needs to be maintained.
